Annual Creditors Notification Return

 
There are two types of Uniform Consumer Credit Code creditors:

1. Registered: Persons who provide for goods and /or services on a credit basis (This also could include persons who provide "cash" loans whose rate does not exceed 10% per year.)

Non-lender creditors - Any business that sells merchandise on credit. 
   Retail merchants such as appliance, jewelry and furniture stores.
   Dealerships such as auto, boat, motorcycle, motor home, mobile home, ATV, and RV's.

Professionals - Any business that sells services on credit. 
   Doctors, lawyers, veterinarians, accountants, dentists, hospitals, etc.

2. Licensed: Persons who make "cash" loans whose rate exceeds 10% per year; or persons who take assignment of cash loans whose rate exceeds 10% per year; or persons who take formal assignment of retail sales contracts (regardless of the interest rate).

Supervised Lenders - Finance Companies; Pawn Shops; Residential Mortgage Companies; Post-dated Check Cashers.

Sales Finance Companies - Primarily engaged in consumer credit activity of taking by assignment or financing in behalf of sellers or lessors (retail consumer sales transactions).

Forms and instructions to complete the notification returns are being provided in a .PDF format.   All forms are formatted for letter-size paper (8 1/2 by 11 inch).  

 

Supervised Lenders - Persons engaged in this State in making consumer credit sales, consumer leases or consumer loans and to a person having an office or place of business who takes assignments of and undertakes direct collection of payments from or enforcement of rights against debtors arising from these sales, leases or loans, subject to the Wyoming Uniform Consumer Credit Code. 

 

Sales Finance Companies - Persons engaged in this State in making consumer credit sales, consumer leases or consumer loans and to a person having an office or place of business who takes assignments of and undertakes direct collection of payments from or enforcement of rights against debtors arising from these sales, leases or loans, subject to the Wyoming Uniform Consumer Credit Code.  

 

Post-dated Check Cashers - Persons engaged in this State in making consumer credit sales, consumer leases or consumer loans and to a person having an office or place of business who takes assignments of and undertakes direct collection of payments from or enforcement of rights against debtors arising from these sales, leases or loans, subject to the Wyoming Uniform Consumer Credit Code. 

 

Pawn Brokers Persons engaged in this State in making consumer credit sales, consumer leases or consumer loans and to a person having an office or place of business who takes assignments of and undertakes direct collection of payments from or enforcement of rights against debtors arising from these sales, leases or loans, subject to the Wyoming Uniform Consumer Credit Code.

 

Non-Lender - Persons engaged in this State in making consumer credit sales or consumer leases subject to the Wyoming Uniform Consumer Credit Code.

 

Professionals - Persons engaged in this State in extending consumer credit subject to the Wyoming Uniform Consumer Credit Code. (Any business that sells services on credit. Doctors, lawyers, veterinarians, accountants, dentists, hospitals, etc.)

 

Collection Agencies- Assignee of obligations from Supervised Loans made in the State of Wyoming (W.S. 40-14-342)

 

Supervised Financial Organization- To be filed by persons engaged in making consumer loans and/or assignees of obligations arising from consumer credit sales, leases, and loans in the State of Wyoming.

 

REMINDER 

WYOMING UNIFORM CONSUMER CREDIT CODE

 RETAIL MERCHANTS WHO ASSESS AN “UNANTICIPATED LATE CHARGE” OR

“RE-BILLING CHARGE” (FINANCE CHARGE) ON CONSUMER ACCOUNTS RECEIVABLES

ARE REMINDED THE MAXIMUM AMOUNT THAT THEY CAN BE ASSESSED IS:

1.75% (21% APR)   OR   FIFTY CENTS (.50˘),   PER MONTH

WHICHEVER IS GREATER, ON THE UNPAID BALANCE OF THE ACCOUNT.

ANY AMOUNT IN EXCESS OF THAT STATED ABOVE IS IN VIOLATION OF

THE UNIFORM CONSUMER CREDIT CODE (UCCC).  PLEASE REVIEW

 YOUR CURRENT CREDIT PRACTICES TO ENSURE YOUR MONTHLY RATE/MINIMUM

FINANCE CHARGE DOES NOT EXCEED THE ABOVE-STATED AMOUNTS.
